District Attorney Daniel J. Barrett reported the following recent criminal case resolutions in the Bradford County Court of Common Pleas, Towanda:

Sentenced

Cynthia Kennedy, 51, Columbia Cross Roads, Pa., was sentenced to Probation supervision for a term of 24 months and a fine of $1,000 plus court costs, restitution of $18,142.91, for the offense of Theft by Deception, a felony of the third degree. Officer Michael Northup of the Troy Borough Police Department arrested Kennedy for the offense in January 2014.

Joshua Vanderpool, 26, Rome, Pa., was sentenced to a term of imprisonment in the Bradford County Correctional Facility from three months to 23 months, 29 days, fines of $300, and court costs, for the offense of Fleeing or Attempting to Elude a Police Officer, a felony of the third degree. Officer John Fedorchak of the Athens Township Police Department arrested Vanderpool for the offense in February 2014.

Heather McMahon, 27, Wysox, Pa., was sentenced to a term of imprisonment in the Bradford County Correctional Facility from four days to six days fines of $1,000 plus court costs, for the offense of Driving under the Influence of Alcohol, a misdemeanor. Officer Bryan Bellows of the Towanda Borough Police Department arrested McMahon for the offense in May 2014.

Tyler Cordner, 20, Troy, Pa., was sentenced to a term of imprisonment in the Bradford County Correctional Facility from 72 hours to six months, and a fine of $1,000 plus court costs, for the offense of Driving under the Influence of Alcohol, a misdemeanor. Trooper William McDermott of the Pennsylvania State Police arrested Cordner following investigation of an incident that occurred in Towanda Township.

Tyler Kutz, 28, Canton, Pa., was sentenced to imprisonment in the Bradford County Correctional Facility for 50 days to 12 months, fines of $100, plus court costs restitution of $409 for the offense of Access Fraud, a misdemeanor of the first degree. Trooper Michael Mislevy of the Pennsylvania State Police arrested Kutz following investigation of an incident that occurred in Towanda Borough.

Cody Parsons, 23, was sentenced to a term of imprisonment in the Bradford County Correctional Facility from two months to 24 months, fines of $250, plus court costs and restitution of $55, for the offense of Theft by Unlawful Taking, a misdemeanor of the second degree. Officer Corey McLinko of the Towanda Borough Police Department arrested Parsons for the offense in October 2014.

Cody Parsons, 23, was sentenced to fines, and costs of $150, for the offense of Harassment, a summary offense. Officer Ryan Edsell of the Towanda Borough Police Department arrested Parsons for the offense in November 2014.

Cody Parsons, 23, of the Bradford County Correctional Facility, was sentenced to a Pennsylvania State Correctional Facility for two months to 12 months, fines of $300 and court costs, for the offense of Criminal Trespass, a misdemeanor of the third degree, Possession of Drug Paraphernalia, an ungraded misdemeanor. Officer Corey McLinko of the Towanda Borough Police Department arrested Parsons for the offense in November 2014.

Cody Parsons, 23, of the Bradford County Correctional Facility, was sentenced to a Pennsylvania State Correctional Facility for 30 days flat plus one month to 12 months, fines of $350 and court costs, for the offense of Open Lewdness, a misdemeanor of the third degree and Disorderly Conduct, a summary offense. Trooper Robert Richter of the Pennsylvania State Police arrested Parsons following investigation of an incident that occurred in Burlington Township.

Terry Hackenberg, 27, of Lock Haven, Pa., was sentenced to imprisonment in the Bradford County Correctional Facility for 90 days flat, followed by Probation supervision for a term of nine months for the offense of Simple Assault, misdemeanor of the second degree. Trooper Brandon Allis of the Pennsylvania State Police arrested Hackenberg following investigation of an incident that occurred in Columbia Township.

Nicholas Fitzpatrick, 20, of Waverly, N.Y., was sentenced to imprisonment in the Bradford County Correctional Facility for 87 days to 23 months, 29 days, fines of $250 plus court costs, and restitution of $10,466.08, for the Burglary, a felony of the second degree. Officer Denny Slater of the Athens Township Police Department arrested Fitzpatrick for the offense on Dec. 10, 2014.

Tonya Cummings, 46, of Canton, Pa., was sentenced to imprisonment in the Bradford County Correctional Facility for 120 days to 60 months, fines of $1,500 plus court costs; she will also lose her driver's license for 18 months, for the offense of Driving under the Influence of Alcohol, a misdemeanor of the first degree. Trooper Joshua Fisher of the Pennsylvania State Police arrested Cummings following investigation of an incident that occurred in Granville Township.

Robert Pierce, 44, of Wysox, Pa., was re-sentenced to imprisonment in Bradford County Correctional Facility for four months to 23 months, 29 days, fines of $500 and court costs for the Corruption of Minors, a misdemeanor of the first degree. Trooper David Pelachick of the Pennsylvania State Police arrested Pierce following investigation of an incident that occurred in Bradford County.

Guilty Pleas

Alan Levin, 53, Hammondsport, N.Y., entered a plea of guilty to the offense of Retail Theft, a misdemeanor of the second degree. Levin will be sentenced on June 18, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer John Fedorchak of the Athens Township Police Department arrested Levin for the offense on Nov. 9, 2014.

Vicki McSparron, 46, Athens, Pa., entered a plea of guilty to the offense of Driving under the Influence of Alcohol, a misdemeanor, and Resisting Arrest, a misdemeanor of the second degree. McSparron will be sentenced on June 15, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer Derek Dekar of the Athens Borough Police Department arrested McSparron for the offense in October 2014.

Cody Parsons, 23, Troy, Pa., entered a plea of guilty to the offense of Open Lewdness, a misdemeanor of the third degree and Disorderly Conduct, a summary offense. Trooper Robert Richter of the Pennsylvania State Police arrested Parsons following investigation of an incident that occurred in West Burlington Township.

Arissa Clymer, 20, Felton, Pa., entered a plea of guilty to the offense of Possession of a Controlled Substance, a misdemeanor. Clymer will be sentenced on June 18, 2015, following preparation of a presentence report by the Bradford County Probation Department. Agents of the Pennsylvania State Police Vice and Narcotics Unit arrested Clymer following investigation of an incident that occurred in Towanda Township.

Accelerated Rehabilitative Disposition (ARD)

Matthew Turner, 23, Sugar Run, Pa., charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and placed on probation for a term of nine months. While on probation, Turner will be subject to supervision by the Bradford County Probation Department, which supervision will include monitoring for drug or alcohol use. Additionally, Turner must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and he will lose his Pennsylvania driving privilege for 60 days. Sergeant David Lantz of the Towanda Borough Police Department filed the charges on Nov. 15, 2014, for the offense in Towanda Borough.

Rodney Babcock, 53, Rome, Pa., charged with the offense of Unsworn Falsification, was accepted into the ARD Program and placed on probation for a term of six months. While on probation Babcock will be subject to supervision by the Bradford County Probation Department, which supervision will include monitoring for drug or alcohol use. Trooper Miranda Musick of the Pennsylvania State Police Department arrested Babcock for the offense in September 2014 in Orwell Township.

Sentenced

Sean Lichtwaid, 31, of Wyalusing, Pa., was sentenced to a term of imprisonment in the Bradford County Correctional Facility for 45 days (flat) and a fine of $2,500, plus court costs, followed by County Intermediate Punishment for 24 months (County Intermediate Punishment involves a combination of restriction and supervision. It may include home confinement, electronic monitor, and substance abuse treatment. Violations can result in incarceration.), for the offense of Driving under the Influence of Alcohol, a misdemeanor of the first degree. Officer Joshua Lake of the Towanda Borough Police Department arrested Lichtwaid for the offense in October 2014.

Cheryl Payne, 52, Columbia Cross Roads, Pa., was sentenced to a term of imprisonment in the Bradford County Correctional Facility from 90 days to 23 months, 29 days, followed by Probation supervision for a term of 12 months, fines of $1,500 plus court costs, for the offense of Driving under the Influence of Alcohol, a misdemeanor of the first degree. Trooper Gabriel Paduck of the Pennsylvania State Police arrested Payne following investigation of an incident that occurred in Wyalusing Township in November 2014.

Levi Cole, 20, Canton, Pa., was sentenced to Probation supervision for a term of 12 months, fines of $500, plus court costs, for the offense of Retail Theft, a misdemeanor of the first degree. Officer John Fedorchak of the Athens Township Police arrested Cole for the offense in September 2014.

Jarred Jayne, 20, Canton, Pa., was re-sentenced to a term of imprisonment in the Bradford County Correctional Facility for 151 days to 18 months, fines of $500, plus court costs, for the offense of Escape, a misdemeanor second degree. Trooper Robert Edgerton of the Pennsylvania State Police arrested Jayne following investigation of an incident that occurred in Canton Township in March 2014.

Marcus Shanks, 37, Huntersville, N.C., was sentenced to a term of imprisonment in the Bradford County Correctional Facility from 33 days to 18 months, fines of $350, plus court costs, restitution of $1,261, for the offense of Simple Assault, a misdemeanor the second degree. Trooper Gabriel Paduck of the Pennsylvania State Police arrested Shanks following investigation of an incident that occurred on Wyalusing Borough in November 2014.

Justin Watson, 34, of Sayre, Pa., was sentenced to imprisonment in a Pennsylvania State Correctional Facility from 20 months to 84 months, fines of $2,000, plus court costs, for the offense of Driving under the Influence of Alcohol, a misdemeanor. Officer Bruce Hoffman of the Sayre Borough Police arrested Watson for the offense in August 2014.

Justin Hayslett, 45, formerly of Athens, Pa., was sentenced to imprisonment in a Pennsylvania State Correctional Facility to 12 months to 60 months, fines of $1,000.00, plus court costs, for the offense of Indecent Assault. Hayslett will be a registered sex offender for life due to the conviction. Officer Timothy Cahill of the Athens Borough Police Department arrested Hayslett for the offense in September.

Dustin James Onofre, 24, Sayre, Pa., was sentenced to imprisonment in the Bradford County Correctional Facility for 10 months to 23 months followed by Probation supervision for a term of seven years, fines of $1,500, plus court costs, for the offense of Possession with Intent to Deliver (Heroin), a felony, Criminal use of a Commutations Facility, a felony. Officer Bruce Huffman of the Sayre Police Department arrested Onofre for the offenses in January 2014.

Guilty Pleas

Kenneth Wise, 62, Sayre, Pa., entered a plea of guilty to the offense of Possession of Drug Paraphernalia, a misdemeanor. Wise will be sentenced on June 29, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer Bruce Hoffman of the Sayre Borough Police Department arrested Wise for the offense in November 2014.

Kimberly Wise, 48, Sayre, Pa., entered a plea of guilty to the offense of Possession of a Controlled Substance, a misdemeanor. Wise will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Officer Bruce Hoffman of the Sayre Borough Police Department arrested Wise for the offense in November 2014.

Conway Garner, 30, Williamsport, Pa., entered a plea of guilty to the offense of Default in required Appearance, a misdemeanor of the second degree. Garner was sentenced to 45 days to 90 days in Bradford County Correctional Facility, and a fine of $50. Deputy Donald Stringham of the Bradford County Sheriff's Officer Department arrested Garner for the offense on Dec. 9, 2014.

Michael Engle, 31, Sayre, Pa., entered a plea of guilty to the offense of Driving under the Influence of Alcohol, a misdemeanor of the first degree. Engle will be sentenced on June 29, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer Andrew Stevens of the Athens Borough Police Department arrested Engle for the offense on Feb. 8, 2015.

Brian Van Dyke, 34, Athens, Pa., entered a plea of guilty to the offense of Resisting Arrest, a misdemeanor of the second degree. Van Dyke will be sentenced following preparation of a presentence report by the Bradford County Probation Department. Chief Christopher Hutchinson of the Athens Borough Police Department arrested VanDyle for the offense on March 5, 2015.

Placement in the Accelerated Rehabilitative Disposition (ARD) Program

Patricia Stroud, 51, Towanda, Pa., charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and placed on probation for a term of nine months. While on probation, Stroud will be subject to supervision by the Bradford County Probation Department, which supervision will include monitoring for drug or alcohol use. Additionally, Stroud must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and he will lose his Pennsylvania driving privilege for 30 days. Trooper Robert Edgerton of the Pennsylvania State Police arrested Stroud for the offense.

Zachary Chilson, 21, Rome, Pa., charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and placed on probation for a term of nine months. While on probation, Chilson will be subject to supervision by the Bradford County Probation Department, which supervision will include monitoring for drug or alcohol use. Additionally, Chilson must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and he will lose his Pennsylvania driving privilege for 60 days. Trooper David Sweeney of the Pennsylvania State Police arrested Chilson for the offense.

Guilty Pleas

Daniel Bell, 65, Towanda, Pa., entered a plea of guilty to the offense of Sexual Abuse of Children (Possession of Pornography), a felony of the third degree, two counts of Possession of a Firearm by Person Convicted of a listed misdemeanor, misdemeanors of the first degree, two counts of Interrupting Communications, a felony of the third degree. Bell will be sentenced on May 18, 2015, following preparation of a presentence report by the Bradford County Probation Department. Detective Albert Ogden of the Towanda Borough Police Department arrested Bell for the offense in September 2014.

Martin Miller, 44, Ulster, Pa., entered a plea of guilty to the offense of Theft, a misdemeanor of the second degree. Miller will be sentenced on July 6, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer Bryan Bellows of the Towanda Borough Police Department arrested Miller for the offense in November.

Martin W. Miller, 44, Ulster, Pa., entered a plea of guilty to the offense of Accident Resulting in Death, a felony of the second degree (leaving the scene of a fatal accident). Miller will be sentenced following preparation of a presentence report by the Bradford County Probation Department. Trooper Robert Richter of the Pennsylvania State Police arrested Miller following investigation of an incident that occurred in Ulster Township.
