Bradford County Court News 7/5/2015

District Attorney Daniel J. Barrett reported that the following persons were recently sentenced in the Bradford County Court of Common Pleas, Towanda:

Arissa Clymer, 20, Felton, Pa., was sentenced to Probation supervision for a term of 12 months, for the offense of Controlled Substance, a misdemeanor. Trooper Michael Adams of the Pennsylvania State Police arrested Clymer following investigation of an incident that occurred in Towanda Township in February 2015.

Kristin Terry, 26, Canton, Pa., was resentenced to imprisonment in a Pennsylvania State Correctional Facility for 62 days to 12 months, fines and court costs of $250, restitution of $37.02, for the offense of Retail Theft, a misdemeanor of the second degree. Officer Trey Kurtz of the Canton Borough Police Department arrested Terry for the offense in November 2013.

Alan Levin, 53, Hammondsport, N.Y., was sentenced to fines plus court costs of $200, for the offense of Retail Theft, a misdemeanor of the second degree. Officer John Fedorchak of the Athens Township Police Department arrested Levin for the offense on Nov. 9, 2014.

Janielle Frantz, 23, Owego, N.Y., was resentenced to imprisonment in the Bradford County Correctional Facility for two months to 23 months, 29 days, fines of $1,000, plus court costs and restitution of $3,747.83, for the offense of Theft by Unlawful Taking, a Felony of the third degree. Officer Eric Keir of the Sayre Borough Police Department arrested Frantz for the offense on Oct. 2, 2013.

Mark Capwell, 20, Sayre, Pa., was sentenced to imprisonment in the Bradford County Correctional Facility for 72 hours to six months, fines, costs, restitution of $1,000; he will also lose his driver's license for 12 months, for the offense of Driving under the Influence of Alcohol, a misdemeanor. Officer Andrew Stevens of the Athens Borough Police Department arrested Capwell for the offense on Oct. 31, 2014.

Bradford County District Attorney, Daniel J. Barrett reported that the following persons recently entered guilty pleas in the Bradford County Court of Common Pleas, Towanda:

Roberto Molina, 37, Canton, Pa., entered a plea of guilty to the offense of Contempt of Court for violation of a Protective Order, (PFA). Roberto was also sentenced by Judge Beirne to 12 days in the Bradford County Correctional Facility for the offense. Trooper Albert Levanavage of the Pennsylvania State Police arrested Molina for the offense on June 15, 2015 in Canton Township.

Roberto Molina, 37, Canton, Pa., entered a plea of guilty to the offense of Driving under the Influence of Alcohol, a misdemeanor. Molina will be sentenced on a later date, following preparation of a presentence report by the Bradford County Probation Department. Officer Trey Kurtz of the Canton Borough Police Department arrested Molina in Canton Township on Jan. 17, 2015.

Tara Smith, 25, Athens, Pa., entered a plea of guilty to the offense of Driving under the Influence of Alcohol, a misdemeanor. Smith will be sentenced on Aug. 6, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer Andrew Stevens of the Athens Borough Police Department arrested Smith for the offense on Jan. 17, 2015.

Nicole Searles, 34, Waverly, N.Y., entered a plea of guilty to the offense of Driving under the Influence of Alcohol, a misdemeanor, and two counts of Possession of Drug Paraphernalia, both misdemeanors. Searles will be sentenced on Aug. 6, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer Nathan Ross of the Sayre Borough Police Department arrested Searles for the offense on Jan. 18, 2015 and April 1, 2015.

Frederick Terrell, 44, Ulster, Pa., entered a plea of guilty to the offense of Theft, a felony of the third degree. Terrell will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Trooper Miranda Musick of the Pennsylvania State Police arrested Terrell following investigation of an incident that occurred in Wysox Township.

Kenneth Rider, 56, Towanda, Pa., entered a plea of guilty to the offense of Driving under the Influence of Alcohol, a misdemeanor of the first degree. Rider will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Trooper Robert Edgerton of the Pennsylvania State Police arrested Rider following investigation of an incident that occurred in Monroeton Township in March 2015.

Nathan Ayers, 22, Mansfield, Pa., entered a plea of guilty to the offense of Driving under the Influence of Alcohol, a misdemeanor of the first degree and Driving while operating Privilege Suspended/revoked, a summary offense. Ayers will be sentenced on July 30, 2015, following preparation of a presentence report by the Bradford County Probation Department. Trooper Joshua Fisher of the Pennsylvania State Police arrested Ayers following investigation of an incident that occurred in Wells Township in February 2015.

Kevin Hoose Jr., 24, Sayre, Pa., entered a plea of guilty to the offense of Person not to Possess Firearm, a felony of the second degree. Hoose will be sentenced on July 30, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer Thomas VanFleet of the Athens Township Police Department arrested Hoose for the offense on Dec. 20, 2014.

Bradford County District Attorney Daniel Barrett reported that the following people were placed on ARD recently in the Court of Common Pleas in Towanda:

Brian Fulda, 53, Athens, Pa., charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and placed on probation for a term of 12 months. While on probation Fulda will be subject to supervision by the Bradford County Probation Department which supervision will include monitoring for drug or alcohol use. Additionally, Fulda must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and he will lose his Pennsylvania driving privilege for 60 days. Corporal Joshua Thompson of the Pennsylvania State Police arrested Fulda for the offense in March 2015, in North Towanda Township.

Shannon Cornish, 38, Sayre, Pa., charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and placed on probation for a term of 12 months. While on probation Cornish will be subject to supervision by the Bradford County Probation Department which supervision will include monitoring for drug or alcohol use. Additionally, Cornish must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and she will lose her Pennsylvania driving privilege for 60 days. Officer Derek Dekar of the Athens Borough Police Department filed the charges in April 2015 for the offense in Athens Borough.

Ann Shrimp, 42, Waverly, N.Y., charged with the offense of Driving under the Influence of Alcohol, a misdemeanor, was accepted into the ARD Program and placed on probation for a term of 12 months. While on probation, Shrimp will be subject to supervision by the Bradford County Probation Department, which supervision will include monitoring for drug or alcohol use. Additionally, Shrimp must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and she will lose her Pennsylvania driving privilege for 30 days. Officer Andrew Stevens of the Athens Borough Police Department filed the charges in January 2015 for the offense in Athens Borough.

Lori Vanderpool, 44, Monroeton, Pa., charged with the offense of Driving under the Influence of Alcohol, a misdemeanor, was accepted into the ARD Program and placed on probation for a term of nine months. While on probation, Vanderpool, will be subject to supervision by the Bradford County Probation Department, which supervision will include monitoring for drug or alcohol use. Additionally, Vanderpool must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and she will lose her Pennsylvania driving privilege for 60 days. Trooper Tyler Brackman of the Pennsylvania State Police arrested Vanderpool for the offense in August 2014 in Monroe Township.

Bradford County District Attorney Daniel J. Barrett reported that the following persons recently entered guilty pleas and were sentenced in Bradford County Magisterial District Courts:

Stephanie Harding, 28, Ulster, Pa., entered a plea of guilty before Magisterial District Judge Timothy Clark to the offense of Harassment, a summary offense and was sentenced to a fine of $50.00, and court costs. Trooper David Sweeney of the Pennsylvania State Police arrested Harding for the offense on May 27, 2015, following investigation of an assault that occurred in Ulster Township. John Harding also pled to Harassment, fined $50.00, same incident.

Jace Borden, 24, Waverly, N.Y., entered a plea of guilty before Magisterial District Judge Michael Shaw to the offense of Defiant Trespass, a misdemeanor of the third degree and was sentenced to 11 days and court costs. Officer Bruce Hoffman of the Sayre Borough Police Department arrested Borden for the offense on June 13, 2015, following investigation of a Defiant Trespass that occurred in Sayre Borough.

Destinie Pruyne, 22, LeRaysville, Pa., entered a plea of guilty before Magisterial District Judge Michael Shaw to the offense of Defiant Trespass, a misdemeanor of the third degree and was sentenced to 10 days and court costs. Officer Rich Horton of the Athens Township Police Department arrested Horton for the offense on June 13, 2015, following investigation of a Defiant Trespass that occurred in Athens Township.

Kody Konco, 20, Athens, Pa., entered pleas of guilty before Magisterial District Judge Michael Shaw to the offense of Possession of Drug Paraphernalia, a misdemeanor, and was sentenced to a fine of $350.00, and court costs. Officer Andrew Stevens of the Athens Borough Police Department arrested Konco for the offense on April 30, 2015, following the investigation of a Possession of Drug Paraphernalia that occurred in Athens Borough.

Bryan Benninger, 41, Sayre, Pa., entered a plea of guilty before Magisterial District Judge Michael Shaw to the offenses of two counts of Possession of Drug Paraphernalia, a misdemeanor, and was sentenced to a fine of $600.00 and court costs. Officer Andrew Stevens of the Athens Borough Police Department and Officer Thomas Zebrowski of the Sayre Borough Police Department arrested Benninger for the offense on May 8, 2015, and May 31, 2015, following the investigation of a Possession of Drug Paraphernalia that occurred in Athens and Sayre Borough.

Randy Talada, 24, Sayre, Pa., entered a plea of guilty before District Magisterial Judge Michael Shaw to the offense of Harassment a summary offense, and was sentenced to court costs. Officer Eric Keir of the Sayre Borough Police Department arrested Talada for the offense on April 30, 2015, following investigation of a Harassment that occurred in Sayre Borough.

Charles Wolcott, 34, Sayre, Pa., entered a plea of guilty before District Magisterial Judge Michael Shaw, to the offense of Harassment, a summary offense, and was sentenced to time served and court costs. Officer Rich Horton of the Athens Township Police Department arrested Wolcott for the offense on April 4, 2015, following investigation of a Harassment that occurred in Athens Township.
