Bradford County Court News 7/12/2015

Bradford County District Attorney Daniel J. Barrett reported that the following persons were recently sentenced in the Bradford County Court of Common Pleas, Towanda:

Kenneth Wise, 62, Sayre, Pa., was sentenced to Probation supervision for a term of 12 months, fines, costs, restitution of $250.00, for the offense of Possession of Drug Paraphernalia, a misdemeanor. Officer Bruce Hoffman of the Sayre Borough Police Department arrested Wise for the offense in November 2014.

Dylan Olmstead, 21, Rome, Pa., was resentenced to a term of imprisonment in the Bradford County Correctional Facility for one month to 12 months, fines, plus costs of $300, restitution of $2,000 for the offense of Receiving Stolen Property, a misdemeanor of the first degree. Trooper Miranda Musick of the Pennsylvania State Police arrested Olmstead following investigation of an incident that occurred in Windham Township in April 2012.

Kimberly Wise, 48, Sayre, Pa., was sentenced to Probation supervision for a term of 12 months, fines, plus court costs of $350, for the offense of Possession of a Controlled Substance, a misdemeanor. Officer Bruce Hoffman of the Sayre Borough Police Department arrested Wise for the offense in November 2014.

Robert Evans, 38, Athens, Pa., was sentenced to a term in the Bradford County Correctional Facility for 35 days to six months, fines and costs of $750, for the offense of Driving under the Influence of Alcohol, a misdemeanor. Officer Andrew Stevens of the Athens Borough Police Department arrested Evans for the offense in January 2015.

Louis Phillippi, 58, Rome, Pa., was sentenced to imprisonment in the Bradford County Correctional Facility for a flat 60 days, followed by County Intermediate Punishment. County Intermediate Punishment involves a combination of restrictions and supervision. It may include home confinement, electronic monitor, and substance abuse treatment. Violations can result in incarceration. Phillippi will pay fines, costs, restitution of $2,500, plus costs, for the offense of Driving under the Influence of Alcohol, a misdemeanor of the first degree. Trooper David Sweeney of the Pennsylvania State Police arrested Phillippi following investigation if an incident that occurred in Windham Township in February 2015.

Robert Swackhammer, 19, Burlington, Pa., was sentenced to Probation supervision for a term of 12 months, fines and, costs of $500, plus costs and $800 restitution for the offense of Theft by Unlawful Taking, a misdemeanor of the first degree. Trooper Joshua Fisher of the Pennsylvania State Police arrested Swackhammer following investigation of an incident that occurred in Burlington Township in December 2014.

Scott Maloney, 33, Towanda, Pa., was sentenced to imprisonment in a Pennsylvania State Correctional Facility for eight months to 16 months, fines and costs of $1,000 plus restitution of $360, for the offense of Possession with intent to Deliver a Controlled Substance, a misdemeanor. Officer John Hennessey of the Towanda Borough Police Department arrested Maloney for the offense in December 2012.

Scott Maloney, 33, Towanda, Pa., was sentenced to imprisonment in a Pennsylvania State Correctional Facility for eight months to 16 months, fines and costs of $1,000, for the offense of Possession with Intent to Deliver a Controlled Substance, a felony. Trooper Michael Adams of the Pennsylvania State Police arrested Maloney following investigation of an incident that occurred in Towanda Borough in March 2013.

Travis Kinner, 26, Monroeton, Pa., was resentenced to imprisonment in the Bradford County Correctional Facility for 36 days (flat), followed by County Intermediate Punishment for a term of 10 months, 24 days, fines and costs of $300, for the offense of Drug Paraphernalia, a misdemeanor. Trooper Mike Adams of the Pennsylvania State Police arrested Kinner following investigation of an incident that occurred in Monroeton Borough.

Travis Kinner, 26, Monroeton, Pa., was sentenced to Probation supervision for a term of 12 months, fines and costs of $400, for the offense of Possession of Drug Paraphernalia, a misdemeanor. Deputy Brian Wibirt of the Bradford County Sheriff's Department arrested Kinner for the offense in March 2015.

David Burdick, 32, Towanda, Pa., entered a plea of guilty to the offense of Accident Involving Damage to Attended Vehicle, a misdemeanor of the third degree. Burdick will be sentenced on Aug. 6, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer Joshua Lake of the Towanda Borough Police Department arrested Burdick for the offense in March 2015.

Peter Venegas, 33, Sayre, Pa., entered a plea of guilty to the offense of Possession of Drug Paraphernalia, a misdemeanor. Venegas will be sentenced on Aug. 6, 2015, following preparation of a presentence report by the Bradford County Probation Department. Trooper Timothy Cahill of the Athens Borough Police Department arrested Venegas for the offense in March 2015.

Mitchell Smith, 19, Canton, Pa., entered a plea of guilty to the offense of Retail Theft, a misdemeanor of the first degree. Smith will be sentenced on Aug. 6, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer John Fedorchak of the Athens Township Police Department arrested Smith for the offense in January 2015.

Dustin Root, 27, Sayre, Pa., entered a plea of guilty to the offense of Driving under the Influence of Alcohol, a misdemeanor. Root will be sentenced on Aug. 10, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer Richard Horton of the Athens Township Police Department arrested Root for the offense in April 2015.

Stacey Terry, 31, Towanda, Pa., entered a plea of guilty to the offense of Possession of Drug Paraphernalia, a misdemeanor. Terry will be sentenced on Aug. 10, 2014, following preparation of a presentence report by the Bradford County Probation Department. Trooper Nate Lewis of the Pennsylvania State Police arrested Terry following investigation of an incident that occurred in Wysox Township in February 2015.

Holden Taylor, 21, Troy, Pa., entered a plea of guilty to the offense of Criminal Mischief, a misdemeanor of the second degree. Taylor will be sentenced on Aug. 10, 2015, following preparation of a presentence report by the Bradford County Probation Department. Trooper Michael O'Boyle of the Pennsylvania State Police arrested Taylor following investigation of an incident that occurred in West Burlington Township in February 2015.

Bradford County District Attorney Daniel J. Barrett reported that the following persons were recently placed in the Accelerated Rehabilitative Disposition (ARD) Program in the Bradford County Court of Common Pleas, Towanda:

Elizabeth Benjamin, 29, Wysox, Pa., charged with Driving under the Influence of Alcohol, was accepted into the ARD Program and placed on probation for a term of nine months. While on probation, Benjamin will be subject to supervision by the Bradford County Probation Department, which supervision will include monitoring for drug or alcohol use. Trooper Tyler Brackman of the Pennsylvania State Police arrested Benjamin for the offense in Wysox Township in March 2015.

Kendra Young, 22, Towanda, Pa., charged with Driving under the Influence of Alcohol, was accepted into the ARD Program and placed on probation for a term of nine months. While on probation, Young will be subject to supervision by the Bradford County Probation Department, which supervision will include monitoring for drug or alcohol use. Additionally, Young must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel; she will also lose her Pennsylvania driving privilege for 30 days. Trooper Tyler Brackman of the Pennsylvania State Police arrested Young for the offense in Ulster Township in January 2015.
