Bradford County Court News 4/19/2015

District Attorney Daniel J. Barrett reported that the following persons were recently sentenced in the Bradford County Court of Common Pleas, Towanda:

Charles Miner, 26, Waverly, N.Y., was sentenced to a term of imprisonment in the Bradford County Correctional Facility for 90 days (flat), fines of $1,500.00, plus court costs, followed by County Intermediate Punishment for 24 months. County Intermediate Punishment involves a combination of restrictions and supervision. It may include home confinement, electronic monitor, and substance abuse treatment. Miner was sentenced for the offense of Driving under the Influence of Alcohol, a misdemeanor of the first degree. Officer George Nichols of the Sayre Borough Police Department arrested Miner for the offense in December 2014.

Kimberly Morse, 28, Monroeton, Pa., was sentenced to Probation supervision for a term of 12 months, fines, costs, restitution of $150.00 fines, court costs, and restitution of $330.00, for the offense of Access Device Fraud, a misdemeanor of the first degree. Officer Corey McLinko of the Towanda Borough Police arrested Morse for the offense in September 2014.

Karen Hagerman, 34, Towanda, Pa., was sentenced to Probation supervision for a term of 12 months, fines and costs, of $250.00, fines, court costs, and restitution of $934.55, for the offense of Theft by Unlawful Taking, a misdemeanor of the second degree.

Trooper William McDermott of the Pennsylvania State Police arrested Hagerman following investigation of an incident that occurred in Wysox Township.

Tia-Jo Evans, 34, Towanda, Pa., was sentenced to imprisonment in the Bradford County Correctional Facility for 72 hours to six months, fines of $1,000.00, plus court costs. She will also lose her driver's license for 12 months. Additional license suspension of 12 months will be imposed for refusal to submit to testing when arrested, for the offense of Driving under the Influence of Alcohol, a misdemeanor. Trooper Michael Tribendis of the Pennsylvania State Police arrested Evans following investigation of an incident that occurred in Towanda Township on June 2, 2014.

Randall Frey, 43, Granville Summit, Pa., was sentenced to imprisonment in the Bradford County Correctional Facility for five days to six months, fines of $500.00 plus court costs. Frey will also lose his driver's license for 18 months, for the offense of Driving under the Influence of Alcohol, a misdemeanor, and Driving without a License, a summary offense. Trooper Michael Tribendis of the Pennsylvania State Police arrested Frey following investigation of an incident that occurred in Granville Township.

Tara Hassler, 29, Canton, Pa., was sentenced to imprisonment in Bradford County Correctional Facility for four months to 23 months, 29 days, fines of $500.00, plus court costs, and buy money of $400.00. Hassler will also lose her driver's license for six months for the offense of Delivery of a Controlled Substance, a Felony. Agents of the Pennsylvania State Police Vice and Narcotics Unit arrested Hassler following investigation of an incident that occurred in Canton Borough.

Kristopher Reeves, 30, Towanda, Pa., was sentenced to Probation supervision for a term of 12 months, fines of $500.00, plus court costs and $135.00 (buy money), for the offense of Delivery of a Controlled Substance, a felony. Agents of the Pennsylvania State Police Vice and Narcotics Unit arrested Reeves following investigation of an incident that occurred in Towanda Township.

James Winterringer, 25, Wysox, Pa., was sentenced to imprisonment in Bradford County Correctional Facility for 45 days, County Intermediate Punishment for 24 months. County Intermediate Punishment involves a combination of restrictions and supervision. It may include home confinement, electronic monitor, and substance abuse treatment. Violations can result in incarceration. Winterringer was sentenced for Driving under the Influence of Alcohol, a misdemeanor of the first degree. Trooper Robert Edgerton of the Pennsylvania State Police arrested Winterringer following investigation of an incident that occurred in Wysox Township on May 31, 2014.

District Attorney Daniel J. Barrett reported that the following persons recently entered guilty pleas in the Bradford County Court of Common Pleas, Towanda:

Walter Reynolds, 27, Monroeton, Pa., entered a plea of guilty to the offense of Burglary, a felony of the first degree. Reynolds will be sentenced following preparation of a presentence report by the Bradford County Probation Department. Trooper Keith Roman of the Pennsylvania State Police arrested Reynolds following investigation of an incident that occurred in Monroe Township in January 2015.

Angie Dolinich, 23, Sayre, Pa., entered a plea of guilty to the offense of Delivery of a Controlled Substance, a felony.

Dolinich will be sentenced on May 15, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer Bruce Hoffman of the Sayre Borough Police Department arrested Dolinich for the offense in December 2014.

Richard Henderson, 27, Athens, Pa., entered a plea of guilty to the offense of Delivery of a Controlled Substance, a felony.

Henderson will be sentenced on May 11, 2015, following preparation of a presentence report by the Bradford County Probation Department. Agents of the Pennsylvania State Police Vice and Narcotics Unit arrested Henderson following investigation of a incident that occurred in Athens Borough.

Shannon Kellam, 37, Athens, Pa., entered a plea of guilty to the offense of Possession of Drug Paraphernalia, a misdemeanor, and Driving under Suspension/DUI related, a summary offense. Kellam will be sentenced on May 28, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer Andrew Stevens of the Athens Borough Police Department arrested Kellam for the offense on Nov. 9, 2014.

Angie Wise, 23, Sayre, Pa., entered a plea of guilty to the offense of Possession of a Controlled Substance, a misdemeanor. Wise will be sentenced on May 11, 2015, following preparation of a presentence report by the Bradford County Probation Department.

Officer Bruce Hoffman of the Sayre Borough Police Department arrested Wise for the offense in August 2013.

Bradford County District Attorney Daniel J. Barrett reported the following resolutions of criminal cases in the Bradford County Court of Common Pleas, Towanda:

SENTENCED

Michael Losey, 44, Canton, Pa., was sentenced to imprisonment in the Bradford County Correctional Facility for 147 days to 12 months, followed by Probation supervision for a term of 12 months, fines of $750.00, and $750.00 Restitution, for the offense of Theft, a misdemeanor of the third degree and Possession of Drug Paraphernalia. Trooper Robert Edgerton of the Pennsylvania State Police arrested Losey following investigation of an incident that occurred in Alba Borough.

Frank Stout, 48, Rochester, N.Y., was sentenced to imprisonment in the Bradford County Correctional Facility for 49 days to six months and fines of $1,100.00, he will also lose his driver's license for 12 months, for the offense of Driving under the Influence of Alcohol, a misdemeanor and Retail Theft, a summary offense. Officer Thomas VanFleet of the Athens Township Police Department arrested Stout for the offense on July 14, 2014.

Matthew Jenner, 32, New Albany, Pa., was resentenced to imprisonment in the Bradford County Correctional Facility for five months to 23 months, 29 days, followed by Probation supervision for a term of 24 months, fines, costs, restitution of $1,350.00, for the offense of False Imprisonment, a misdemeanor of the second degree, Simple Assault, misdemeanor of the second degree, Criminal Trespass, a misdemeanor of the third degree and Driving under Suspension, a summary offense. Trooper Michael Moser of the Pennsylvania State Police arrested Jenner following investigation of an incident that occurred in New Albany Township.

Robert Carlton, 33, Athens, Pa., was sentenced to Probation supervision for a term of six months, and fines of $300.00 plus court costs, for the offense of Simple Assault, misdemeanor of the second degree. Officer Travis Snyder of the Sayre Borough Police Department arrested Carlton for the offense in July 2014.

Curtis Opdyke, 23, of Canton, Pa., was sentenced to imprisonment in Bradford County Correctional Facility for four days to six months, fines of $1,000.00, plus court costs, for the offense of Driving under the Influence of Alcohol, a misdemeanor. Trooper Robert Richter of the Pennsylvania State Police arrested Opdyke following investigation of an incident that occurred in Troy Township.

Curtis Opdyke, 23, of Canton, Pa., was sentenced to imprisonment in Bradford County Correctional Facility for 35 days to six months, fines of $750.00, plus court costs, for the offense of Driving under the Influence of Alcohol, a misdemeanor. Trooper William McDermott of the Pennsylvania State Police arrested Opdyke following investigation of an incident that occurred in Canton Township.

Curtis Opdyke, 23, of Canton, Pa., was sentenced to Probation supervision for a term of 12 months, fines of $300.00, plus court costs, for the offense of Possession of Drug Paraphernalia, a misdemeanor. Trooper Tyler Brackman of the Pennsylvania State Police arrested Opdyke following investigation of an incident that occurred in Springfield Township.

Kristen Terry, 26, of Canton, Pa., was sentenced to Probation supervision for a term of 12 months, fines of $250.00, restitution of $37.02 and court costs, for the offense of Retail Theft, a misdemeanor of the second degree. Officer Trey Kurtz of the Canton Borough Police Department arrested Terry for the offense in November 2013.

GUILTY PLEAS

Shaking Jones, 32, New York, N.Y., entered a plea of guilty to the offense of Theft by Deception, a misdemeanor of the second degree. Jones will be sentenced on June 1, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer Richard Horton of the Athens Township Police Department arrested Jones for the offense on Dec. 7, 2014.

Kenneth Shuss, 41, Boothwyn, Pa., entered a plea of guilty to the offense of Possession of a Controlled Substance, a misdemeanor and Possession of drug Paraphernalia, also a misdemeanor. Shuss will be sentenced following preparation of a presentence report by the Bradford County Probation Department. Officer Bruce Hoffman of the Sayre Borough Police Department arrested Shuss for the offense in November 2014 in Sayre Borough.

Curtis Opdyke, 23, Canton, Pa., entered a plea of guilty to the offense of Driving under the Influence of Alcohol, a misdemeanor.

Trooper William McDermott of the Pennsylvania State Police arrested Opdyke following investigation of an incident that occurred in Canton Township.

Michael Losey, 44, Canton, Pa., entered a plea of guilty to the offense of Possession of Drug Paraphernalia, a misdemeanor.

Losey will be sentenced following preparation of a presentence report by the Bradford County Probation Department. Trooper Robert Edgerton of the Pennsylvania State Police arrested Losey following investigation of an incident that occurred in Alba Borough.

Carrie Labarr-McKean, 45, Ulster, Pa., entered a plea of guilty to the offense of delivery of a Controlled Substance, a felony.

Labarr-McKean will be sentenced on May 28, 2015, following preparation of a presentence report by the Bradford County Probation Department. Agents of the Vice and Narcotics Unit arrested Labarr-McKean following investigation of an incident that occurred in Towanda Borough.

Jennifer Smith, 37, Towanda, Pa., entered a plea of guilty to the offense of Possession of a Controlled Substance, a misdemeanor.

Smith will be sentenced on May 28, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer John Hennessy the Towanda Borough Police Department arrested Smith for the offense in December 2013 in Towanda Borough.

Roni Vanness, 30, Athens, Pa., entered a plea of guilty to the offense of Possession of Drug Paraphernalia, a misdemeanor and Possession of a Controlled Substance also a misdemeanor. Vanness will be sentenced on June 1, 2015, following preparation of a presentence report by the Bradford County Probation Department. Officer Nikki Hoffman of the Sayre Borough Police Department arrested Vanness for the offense in December 2014 in Athens Borough.

James Taylor, 26, Towanda, Pa., entered a plea of guilty to the offense of Retail Theft, a misdemeanor of the second degree.

Taylor will be sentenced on June 1, 2015, following preparation of a presentence report by the Bradford County Probation Department. Trooper Joshua Fisher of the Pennsylvania State Police arrested Taylor following investigation of an incident that occurred in Wysox Township.

NOLO CONTENDERE

Bradford County District Attorney Daniel J. Barrett reported that the following person(s) recently entered a plea of Nolo Contendere in the Bradford County Court of Common Pleas, Towanda:

David Kithcart, 22, Lockwood, N.Y., entered a plea of nolo contendere/no contest to Burglary, a felony of the second degree.

Kithcart will be sentenced on May 28, 2015, following preparation of a pre-sentence report by the Bradford County Probation Department. A no-contest plea is entered where the defendant cannot recall the event but will be held guilty and sentenced.

Officer Nathan Ross of the Sayre Borough Police arrested Kithcart for the offense on Jan. 11, 2015.

CRIMINAL CASE RESOLUTIONS

Bradford County District Attorney Daniel J. Barrett reported the following recent Bradford County criminal case resolutions:

Magisterial District Court

Blaine Boyer, 25, Towanda, Pa., entered a plea of guilty before Magisterial District Judge Michael Shaw to the offense of Possession of Drug Paraphernalia, a misdemeanor, and was sentenced to 14 days and court costs. Officer Andrew Stevens of the Athens Borough Police Department arrested Boyer for the offense on March 15, 2015, following investigation of a Possession of drug Paraphernalia that occurred in Athens Borough.

Kevin Salsman, 54, Sayre, Pa., entered a plea of guilty before Magisterial District Judge Michael Shaw to the offense of Possession of Drug Paraphernalia, a misdemeanor, and was sentenced to a fine of $200.00, and court costs. Officer Andrew Salsman of the Athens Borough Police Department arrested Salsman for the offense on Feb. 16, 2015, following investigation of a Possession of Paraphernalia that occurred in Sayre Borough.

Samantha Decker, 26, Monroeton, Pa., entered a plea of guilty before Magisterial District Judge Jonathan Wilcox to the offense of Theft by Unlawful Taking, a misdemeanor of the third degree and was sentenced to restitution of $139.00, and court costs.

Trooper Steve Steranski of the Pennsylvania State Police arrested Decker for the offense on Oct. 8, 2015, following investigation of a Theft that occurred in West Burlington Township.

Shane Furman, 26, Wysox, Pa., entered a plea of guilty before Magisterial District Judge Fred Wheaton to the offense of Possession of Drug Paraphernalia, a misdemeanor of the third degree and was sentenced to court costs. Deputy Donald Stringham of the Bradford County Sheriff's Office arrested Furman for the offense on Feb. 20, 2015, following investigation of a Possession of Drug Paraphernalia that occurred in Wysox Township.

Shawn Lewis, 36, Wysox, Pa., entered a plea of guilty before Magisterial District Judge Timothy Clark to the offense of Possession of Drug Paraphernalia, a misdemeanor and was sentenced to a fine of $100.00 and court costs. Agents of the Pennsylvania State Police Vice and Narcotics Unit arrested Lewis for the offense on Aug. 15, 2014, following investigation of a possession of drug paraphernalia that occurred in Towanda Township.

Aaron Vanderpool, 33, Wysox, Pa., entered a plea of guilty before Magisterial District Judge Timothy Clark to the offense of Possession of Drug Paraphernalia, a misdemeanor and was sentenced to a fine of $100.00, and court costs. Agents of the Pennsylvania State Police Vice and Narcotics Unit arrested Vanderpool for the offense on Aug. 15, 2014, following investigation of a Possession of Paraphernalia that occurred in Towanda Township.
