Bradford County Court News 3/23/2014

Bradford County District Attorney Daniel J. Barrett announced that the following persons recently were sentenced in the Bradford County Court of Common Please, Towanda:

Valerie Bennici, 33, of Towanda, PA, was sentenced to County Intermediate Punishment for 24 months and a fine of $250. She will lose her driver's license for six months for the offense of Possession of a Controlled Substance with Intent to Deliver, a felony. Officer Thomas VanFleet of the Athens Township Police Department arrested Bennici for the offense in Dec. 16, 2013.

Robert Coles Jr, 43, Granville Summit, PA, was sentenced to a term of Probation for a term of 12 months and a fine of $600, for the offense of two counts of Driving under the Influence of Alcohol, a misdemeanor.

Trooper Joshua Fiske and Trooper Christopher Shelly of the Pennsylvania State Police arrested Coles following investigation of an incident that occurred in Granville Township and on September and October 2013.

Darrel Moser, 26, Ulster, PA, was sentenced to a term of imprisonment in the Bradford County Correctional Facility of from nine days to 23½ months, and a fine of $250, for the offense of Simple Assault, a misdemeanor of the second degree. Trooper James Dughi of the Pennsylvania State Police arrested Moser following investigation of an incident that occurred in November 24, 2013.

Frederick Peake, 47, Athens, PA, was sentenced to a term of imprisonment in the Bradford County Correctional Facility for 90 days and a fine of $4000, he will also lose his driver's license for 36 months, for the offense of (two counts) Driving under the Influence of Alcohol, a misdemeanor of the first degree. Officer Timothy Cahill of the Athens Borough Police Department arrested Peake for the offense in Sept. 26, 2013. Trooper Joshua Fisher of the Pennsylvania State Police arrested Peake following investigation of an incident that occurred in Burlington Township.

Robert Foster, 37, Canton, PA, was sentenced to a term of County Intermediate Punishment for 24 months and a fine of $1500; he will also lose his driver's license for 18 months for the offense of Driving under the Influence of Alcohol, a misdemeanor of the first degree. Officer Donald Stringham of the Towanda Borough Police Department arrested Foster for the offense in July 11, 2013.

Shawn McKean, 27, Monroeton, PA, was resentenced following revocation of a sentence of Probation to Probation for a term of one year for the offense of Open Lewdness, a misdemeanor of the third degree. Trooper David Pelachick of the Pennsylvania State Police arrested McKean following invesitagation of an incident that occurred in Towanda Township.

Robert Strope, 42, Sayre, PA, was sentenced to a term of imprisonment in the Bradford County Correctional Facility of from four days to six months and a fine of $1,000; he will also lose his driver's license for 12 months for the offense of Driving under the Influence of Alcohol, a misdemeanor. Officer Cody Welch of the Athens Borough Police Department arrested Strope for the offense in July, 2014.

Edward Lichtenfelts, 21, Towanda, PA, was sentenced to a term of imprisonment in the Bradford County Correctional Facility of from 83 days to 23 ½ months followed by Probation for a term of nine months and a fine of $500, for the offense of Access Device Fraud, a misdemeanor of the first degree and Attempted Theft, a misdemeanor of the second degree. Officers Joshua Lake and Sergeant David Lantz of the Towanda Borough Police Department arrested Lichtenfelts for the offenses in June and December 2013.

Gary Mapes Jr, 38, Middletown, NY, was sentenced to a term of imprisonment in Bradford County Correctional Facility of from five months to 23 ½ months and a fine of $250, for the offense of Receiving Stolen Property, a misdemeanor of the second degree. Officer John Fedorchak of the Athens Township Police Department arrested Mapes for the offense in Sept. 10, 2012.

Derek Shaubacher, 34, Canton, PA, was sentenced to a term of imprisonment in Bradford County Correctional Facility of from six months to 18 months and a fine of $1500, he will also lose his driver's license for 18 months, for the offense of Driving under the Influence of Alcohol, a misdemeanor. Officer Trey Kurtz of the Canton Borough Police Department arrested Shaubacher for the offense in July.

Joan Garinger, 43, Towanda, PA, was sentenced to a term of imprisonment in Bradford County Correctional Facility of from four months to 23 months, followed by Probation for 18 months; she will also lose her driver's license for 60 months, for the offenses of five counts of Possession of Controlled Substance and two counts of Drug Paraphernalia. Trooper Michael Adams and Trooper Robert Hutchison of the Pennsylvania State Police arrested Garinger in September and December 2012 and Trooper Anthony Stempien arrested her in February 2013.

Michael Garinger, 43, Towanda, PA, was sentenced to a term of imprisonment in a Pennsylvania State Correctional Facility of from one month to four months, followed by Probation for six months; he will also lose his driver's license for six months, for the offenses of Possession of a Controlled Substance and Possession of Drug Paraphernalia. Trooper Anthony Stempien of the Pennsylvania State Police arrested Garinger following investigation of an incident that occurred in Towanda Township.

Michael Garinger, 43, Towanda, PA, was sentenced to a term of imprisonment in a Pennsylvania State Correctional Facility of from three months to 12 months, followed by Probation for six months and a fine of $1500; he will also lose his driver's license for 36 months, for the offenses of Possession of Heroin, Marijuana and MDPV-bath salts and Drug Paraphernalia. Trooper Michael Adams of the Pennsylvania State Police arrested Garinger following investigation of an incident that occurred in September 2012 in Monroe Township.

Michael Garinger, 43, Towanda, PA, was sentenced to a term of imprisonment in a Pennsylvania State Correctional Facility of from 10 months to 24 months, for the offenses of Possession with intent to Deliver and Possession of a Controlled Substance. Trooper Robert Hutchison of the Pennsylvania State Police arrested Garinger following investigation of an incident that occurred in Monroe Township. The total of three sentences was 14 to 38 months in Pennsylvania State Prison followed by 12 months probation.

Randolph Potter, 50, of Towanda, PA, he was also ordered to pay restitution of $790, and a fine of $100 and court costs, for the offense of bad check. Chief County Detective Kyle Wisel arrested Potter for the offense.

Bradford County District Attorney Daniel J. Barrett announced that the following persons recently entered pleas of guilty in the Bradford County Court of Common Pleas, Towanda:

Kyle Peppard, 28, Waverly, NY, entered a plea of guilty to the offense of Disorderly Conduct, a misdemeanor of the third degree. Peppard will be sentenced on May 1, 2014, following preparation of a presentence report by the Bradford County Probation Department. Officer Jeremy Horton of the Sayre Borough Police Department arrested Peppard for the offense in December, 2013.

Jerry Lee Winebarger, 54, Panton, PA, entered a guilty plea to the offense of Possession of Drug Paraphernalia, a misdemeanor. Winebarger will be sentenced on May 12, 2014, following preparation of a presentence report by the Bradford County Probation Department. Officer Joshua Heckman of the Canton Borough Police Department arrested Winebarger for the offense in August 2013.

Jennifer Devine, 40, Towanda, PA, entered a plea of guilty to the offense of delivery of a Controlled Substance, a felony. Devine will be sentenced on May 12, 2014, following preparation of a presentence report by the Bradford County Probation Department. Agents of the Pennsylvania State Police Vice and Narcotics Unit arrested Devine following investigation of an incident that occurred in Sheshequin Township on September 23, 2013.

Leah Maleski, 42, Sugar Run, PA, entered a plea of guilty to the offense of delivery of a Driving under the Influence of Alcohol, a misdemeanor. Maleski will be sentenced on May 12, 2014, following preparation of a presentence report by the Bradford County Probation Department. Trooper Matthew Grebeck of the Pennsylvania State Police arrested Maleski following investigation of an incident that occurred in Wyalusing Township on Sept. 28, 2013.

Michael P. Burgess, 35, Towanda, PA, entered a plea of guilty to the offense of Possession of a Controlled Substance, a misdemeanor. Burgess will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Officer John Hennessey of the Towanda Borough Police Department arrested Burgess for the offense in November.

Charles Malenke, 48, Troy, PA, entered a plea of guilty to the offense of Obstruction, a misdemeanor of the second degree. Malenke will be sentenced on May 15, 2014, following preparation of a presentence report by the Bradford County Probation Department. Trooper Miranda Musick of the Pennsylvania State Police arrested Malenke following investigation of an incident that occurred in North Towanda Township.

William Hicks, 25, Towanda, PA, entered a plea of guilty to the offense of Possession of Drug Paraphernalia, a misdemeanor. Trooper Robert Hutchison of the Pennsylvania State Police arrested Hicks following investigation of an incident that occurred in Towanda Borough.

Taylor Machmer, 19, Canton, PA, entered a plea of guilty to the offense of Possession of Drug Paraphernalia, a misdemeanor. Machmer will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Trooper Mark Sadlowski of the Pennsylvania State Police arrested Machmer following investigation of an incident that occurred in Canton Township in September 2013.

Taylor Machmer, 19, Canton, PA, entered a plea of guilty to the offense of Possession of Drug Paraphernalia, a misdemeanor. Machmer will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Trooper Michael Adams of the Pennsylvania State Police arrested Machmer following investigation of an incident that occurred in Canton Township in October 2013.

David L. Harding, 25, Tunkhannock, PA, entered a plea of guilty to the offense of Delivery of Methamphetamine, a felony. Harding will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Trooper Robert Hutchison of the Pennsylvania State Police arrested Harding following investigation of an incident that occurred in Athens Township on August 2012.

Thomas Craven, 47, Scranton, PA, entered a plea of guilty to the offense of Driving while under a Habitual Offender Suspension, driving while under DUI suspension, a summary offense, and other summary offenses.

Craven will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Trooper Mark Sadlowski of the Pennsylvania State Police arrested Craven following investigation of a incident that occurred in Tuscarora Township.

Randolph Potter, 50, Towanda, PA, entered a plea of guilty to the offense of bad checks, a summary offense.

Chief County Detective Kyle Wisel of the District Attorney's Office arrested Potter for the offense in August.

Taylor Machmer, 19, Canton, PA, entered a plea of guilty to the offense of Possession of Drug Paraphernalia, a misdemeanor. Machmer will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Officer Trey Kurtz of the Canton Borough Police Department arrested Machmer for the offense in July 2013.

Nicole Chandler, 23, Troy, PA, entered a plea of guilty to the offense of Possession of MDPV bath salts, a misdemeanor. Chandler will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Officer Bruce Hoffman of the Pennsylvania State Police arrested Chandler following investigation of an incident that occurred in Sayre Borough.

Nicole Chandler, 23, Troy, PA, entered a plea of guilty to the offense of Possession of Drug Paraphernalia, a misdemeanor. Chandler will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Officer Sean Flynn of the Pennsylvania State Police arrested Chandler following investigation of an incident that occurred in Sayre Borough.

Larry B. Bennett, 54, Towanda, PA, entered a plea of guilty to the offense of Possession of bath salts, a felony. Bennett will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Trooper Michael Adams of the Pennsylvania State Police arrested Bennett following investigation of an incident that occurred in Monroe Township.

Gerald Vanderpool, 53, Rome, PA, entered a plea of guilty to the offense of Driving under the Influence of Alcohol, a misdemeanor. Vanderpool will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Trooper Michael Moser of the Pennsylvania State Police arrested Vanderpool following investigation of an incident that occurred in Litchfield Township.

Eric Dinelli, 27, Towanda, PA, entered a plea of guilty to the offense of Driving under the Influence of Alcohol, a misdemeanor of the first degree. Dinelli will be sentenced on May 15, 2014, following preparation of a presentence report by the Bradford County Probation Department. Trooper Matthew Grebeck of the Pennsylvania State Police arrested Dinelli following investigation of an incident that occurred in Towanda Township in September 2013.

Bradford County District Attorney Daniel J. Barrett announced that the following persons were recently placed in the Accelerated Rehabilitative Disposition (ARD) program in the Bradford County Court of Common Pleas, Towanda:

Darrell Mosier, 26, Ulster, PA, charged with the offense of Theft, was accepted into the ARD Program and placed on probation for a term of 18 months. While on probation, Mosier will be subject to supervision by the Bradford County Probation Department, which supervision will include monitoring for drug or alcohol use. Additionally, Mosier must perform 40 hours of community service. Trooper Tyler Brackman of the Pennsylvania State Police arrested Mosier for the offense in Wysox Township.

Kyle Dunn, 30, Monroeton, PA, charged with the offense of Indecent Exposure, was accepted into the ARD Program and placed on probation for a term of 12 months. While on probation, Dunn will be subject to supervision by the Bradford County Probation Department, also to have a Mental Health Evaluation. Additionally, Dunn must perform community service. Trooper Kevin Hibson of the Pennsylvania State Police arrested Dunn for the offense in September 2013 in Wysox Township.

Ebed Delozier, 28, Falls, PA, charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and placed on probation for a term of 12 months. While on probation, Delozier will be subject to supervision by the Bradford County Probation Department, which supervision will include monitoring for drug or alcohol use. Additionally, Delozier must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel as conditions of ARD placement; he will also lose his Pennsylvania driving privilege for 60 days. Corporal Peter Smith of the Pennsylvania State Police arrested Delozier for the offense on August 16, 2013 in Terry Township.

Jason White, 22, Athens, PA, charged with the offense of Theft, was accepted into the ARD Program and placed on probation for a term of six months. While on probation, White will be subject to supervision by the Bradford County Probation Department, which supervision will include monitoring for drug or alcohol use. Additionally, White must perform community service and pay restitution of $34. Officer Denny Slater of the Athens Township Police Department filed the charges in November 18, 2013, for the offense in Athens Township.

Bonnie Henry, 59, Sayre, PA, charged with the offense of Hindering Apprehension, was accepted into the ARD Program and placed on probation for a term of eight months. While on probation Henry will be subject to supervision by the Bradford County Probation Department, which supervision will include monitoring for drug or alcohol use. Additionally, Henry must perform 10 hours of community service. Officer Travis Snyder of the Sayre Borough Police Department filed the charges in Dec. 27, 2013 for the offense in Sayre Borough.

Denise Hurd, 33, Sayre, PA, charged with the offense of Endangering the Welfare of Children, was accepted into the ARD Program and placed on probation for a term of six months. While on probation Hurd will be subject to supervision by the Bradford County Probation Department, which supervision will include monitoring for drug or alcohol use. Additionally, Hurd must perform 10 hours of community service. Officer Daniel Thomas of the Athens Township Police Department filed the charges in Nov. 16, 2013 for the offense in Athens Township.

Ellen Lattimer, 33, Elmira Heights, NY, charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and placed on probation for a term of 12 months. While on probation Lattimer must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and she will lose her Pennsylvania driving privilege for 30 days. Officer Travis Snyder of the Sayre Police Department filed the charges in October for the offense in Sayre Borough.

District Attorney Daniel J. Barrett announced that the following persons were recently sentenced in the Bradford County Court of Common Pleas, Towanda:

Gina Trust, 34, Endicott, NY, was resentenced following revocation of a sentence of probation to probation for a term of one year and a fine of $500.00 for the offense of Attempting to Possess a Controlled Substance, a misdemeanor. Officer Thomas VanFleet of the Athens Township Police Department arrested Trust for the offense in July 24, 2011.

Raymond Richlin, 28, Tunkhannock, PA, was sentenced to a term of imprisonment in the Bradford County Correctional Facility of from five days to six months, 90 days, followed by Probation for a term of 12 months, he was also ordered to pay restitution of $7921.75 and fines of $2050.00, he will also lose his driver's license for 12 months and an additional license suspension of 12 months will be imposed for refusal to submit to testing when arrested, for the offenses of Driving under the Influence of Alcohol, a misdemeanor, Simple Assault, a misdemeanor of the first degree and Public Drunkenness, a summary offense and Driving under Suspension also a summary offense. Trooper Matthew Grebeck and Trooper Michael Moser of the Pennsylvania State Police arrested Richlin following investigation of incidents that occurred in Standing Stone Township in May and August 2013.

Timothy McDonald, 54, West Lebanon, PA, was sentenced to a term of imprisonment in the Bradford County Correctional Facility of from 90 days to 36 months, and a fine of $1500.00, he will also lose his driver's license for 18 months and an additional license suspension of 18 months will be imposed for refusal to submit to testing when arrested, for the offense of Driving under the Influence of Alcohol, a misdemeanor of the first degree. Trooper David Sweeney of the Pennsylvania State Police arrested McDonald following investigation of an incident that occurred in Wysox Township in August 2013.

Abraham J. Pickering, 37, Wyalusing, PA, was sentenced to Probation for a term of 12 months and a fine of $100.00 for the offense of violating a protection from abuse order. Trooper Robert Edgerton of the Pennsylvania State Police arrested Pickering following investigation of an incident that occurred in Herrick Township.

Owanda Zimmerman, 41, Elmira, NY, was sentenced to Probation for a term of 24 months and a fine of $350.00 for the offense of Delivery of a Controlled Substance (MDPV bath-salts). Trooper Robert Hutchison of the Pennsylvania State Police arrested Zimmerman following investigation of an incident that occurred in Athens Township in July 2012. The sentence will run consecutive to another sentence imposed in Bradford County and Wyoming County that have placed Zimmerman in Pennsylvania State Prison.

Owanda Zimmerman, 41, Elmira, NY, was sentenced to Pennsylvania State Correctional Facility of from one year to four years and a fine of $500.00 for the offense of Delivery of a Controlled Substance-Heroin. Trooper Michael Adams of the Pennsylvania State Police arrested Zimmerman following investigation of an incident that occurred in Athens Township in August 2012. Zimmerman is serving other sentences for Drug offenses in Wyoming and Bradford County.

Bradford County District Attorney, Daniel J. Barrett announced that the following persons recently entered guilty pleas in the Bradford County Court of Common Pleas, Towanda:

Richard Laye Jr, 54, Waverly, NY, entered a plea of guilty to the offense of three counts of Driving under the Influence of Alcohol, a misdemeanor of the first degree. Laye will be sentenced following preparation of a presentence report by the Bradford County Probation Department. Officer Jason Serfas of the Athens Township Police Department arrested Serfas for the offenses on December 28, 2013 and January 6, 2014. Trooper David Sweeney of the Pennsylvania State Police arrested Laye following investigation of an incident that occurred in Wysox Township on December 28, 2013.

Kyle Repsher, 24, Laceyville, PA, entered a plea of guilty to the offense of Driving under the Influence of Alcohol, a misdemeanor of the second degree. Repsher will be sentenced on May 15, 2014, following preparation of a presentence report by the Bradford County Probation Department. Trooper David Sweeney of the Pennsylvania State Police arrested Repsher following investigation of an incident that occurred in Wyalusing Borough on August 24, 2013.

Ryan Hunsinger, 20, Athens, PA, entered a plea of guilty to the offense of Default in Required Appearance, a misdemeanor of the second degree, and Receiving Stolen Property, also a misdemeanor of the second degree. Hunsinger will be sentenced on April 17, 2014, following preparation of a presentence report by the Bradford County Probation Department. Officer Nikki Hoffman of the Athens Borough Police Department arrested Hunsinger for the offense in November 19, 2013.

Dale E. Hart, 59, Columbia Township, entered a plea of guilty to the offense of Obstructing, a misdemeanor of the second degree. Hunsinger will be sentenced, following preparation of a presentence report by the Bradford County Probation Department. Trooper Brandon Allis of the Pennsylvania State Police arrested Hart following investigation of an incident that occurred in Columbia Township.

Chrystal M. Rivera, 25, Athens, PA, entered a plea of guilty to the offense of Driving under the Influence of Alcohol, a misdemeanor of the first degree. Rivera will be sentenced on April 17, 2014, following preparation of a presentence report by the Bradford County Probation Department. Officer Derek Dekar of the Athens Borough Police Department arrested Rivera for the offense in October.

Bradford County District Attorney Daniel Barrett announced that the following people were placed on ARD recently in the Court of Common Pleas in Towanda Pennsylvania:

Kyle Mowry, 21, Sayre, PA charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and placed on probation for a term of nine months. While on probation Mowry will be subject to supervision by the Bradford County Probation Department which supervision will include monitoring for drug or alcohol use. Additionally, Mowry must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and he will lose his Pennsylvania driving Privilege for 30 days. Trooper Michael Moser of the Pennsylvania State Police arrested Mowry for the offense in October 13, 2013 in Towanda Borough.

Jordan Kennedy, 22, Columbia Cross Roads, PA charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and placed on probation for a term of nine months. While on probation Kennedy will be subject to supervision by the Bradford County Probation Department which supervision will include monitoring for drug or alcohol use. Additionally, Kennedy must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and he will lose his Pennsylvania driving Privilege for 30 days. Trooper Christopher Stecik of the Pennsylvania State Police arrested Kennedy for the offense in November 8, 2013 in Ulster Township.

Travis Geisinger, 25, Sayre, PA charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and placed on probation for a term of 12 months. While on probation Geisinger will be subject to supervision by the Bradford County Probation Department which supervision will include monitoring for drug or alcohol use. Additionally, Geisinger must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and he will lose his Pennsylvania driving Privilege for 60 days. Officer Travis Snyder of the Sayre Borough Police Department arrested Geisinger for the offense in Sayre Borough.

John Adamietz, 23, Wyalusing, PA, charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and place on probation for a term of nine months. While on probation Adamietz will be subject to supervision by the Bradford County Probation Department which supervision will include monitoring for drug or alcohol use. Additionally, Adamietz must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and he will lose his Pennsylvania driving Privilege for 30 days. Trooper Christopher Shelly of the Pennsylvania State Police arrested Adamietz for the offense on November 2, 2013, in Tuscarora Township.

John Palfreyman Jr, 34, Sayre, PA, charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and place on probation for a term of 12 months. While on probation Palfreyman will be subject to supervision by the Bradford County Probation Department which supervision will include monitoring for drug or alcohol use. Additionally, Palfreyman must perform 40 hours of community service. Trooper Tyler Brackman of the Pennsylvania State Police arrested Palfreyman for the offense on September 20, 2013, in Ulster Township.

David Conklin, 23, Milan, PA, charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and place on probation for a term of 12 months. While on probation Conklin will be subject to supervision by the Bradford County Probation Department which supervision will include monitoring for drug or alcohol use. Additionally, Conklin must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and he will lose his Pennsylvania driving privilege for 60 days. Sergeant James Shaw of the Athens Township Police Department filed the charges in November for the offense in Athens Township.

Lauren Moody, 29, Athens, PA, charged with the offense of Driving under the Influence of Alcohol, was accepted into the ARD Program and placed on probation for a term of 12 months. While on probation Moody will be subject to supervision by the Bradford County Probation Department which supervision will include monitoring for drug or alcohol use. Additionally, Moody must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel and she will lose her Pennsylvania driving privilege for 30 days. Officer Cody Welch of the Athens Borough Police Department arrested Moody.

Dawn Faust, 58, Gillett, PA, charged with the offence of Welfare Fraud, was accepted into the ARD Program and placed on probation for a term of 12 months. While on probation Faust will be subject to supervision by the Bradford County Probation Department which supervision will include monitoring for drug or alcohol use.
