Police Briefs

Two men charged for letting dogs run loose

Calvin Adams, 18, and Steven Vanderpool, 19, have been charged with failure to confine their dogs relating to a Aug. 6 incident on the 400 block of Spring Hill Road in Tuscarora Township.

According to police, this is not the first time the dogs have been running free in the neighborhood.

Both men were issued non-traffic citations for their role in the incident.

Man charged with aggravated indecent assault of minors

Edward Leroy Caywood, 75, of Rocky Mount, North Carolina has been charged with aggravated indecent assault, indecent assault and corruption of minors relating to two incidents on Aug. 17 and Aug. 19 in Windham Township.

According to police, the two victims, aged eight and nine, were improperly touched by Caywood.

Caywood admitted to sexually assaulting the victims, police said.

Caywood was arraigned before Magisterial District Judge Timothy Clark and remanded to the Bradford County Correctional Facility in lieu of $30,000 bail.

False rape report

Lisa Ann Saemmer, 25, of Palmerton has been charged with making false statements to police relating to a Aug. 5 incident on Chestnut St. in Wyalusing Borough.

According to police, Saemmer claimed she was raped and upon further investigation it was found to be untrue.

Truck vandalized in Orwell Twp.

State police are investigating a report of criminal mischief that occurred between Aug. 12 and Aug. 14 on State Route 467 in Orwell Township.

According to police, an unknown person used an unknown object to smash the victim's passenger side rear window of a 2012 Dodge Ram 1500.

Two men injure each other in fight

Robert Ralph Shupp Sr., 55, of Factoryville and Richard Neil Sherman, 53, of Laceyville have both been charged with simple assault and harassment relating to a Aug. 5 incident at 1733 Spring Hill Road in Tuscarora Township.

According to police, the two men got into a verbal argument that turned physical over a business agreement.

Both men sustained minor injuries during the incident, police said.

Shupp and Sherman have been sent a summons to appear before Magisterial District Judge Fred Wheaton on Sept. 3 for a preliminary hearing.

Woman charged with possession of marijuana

Lisa Marie Boss, 51, of Rome has been charged with possession of a controlled substance and possession of drug paraphernalia relating to a July 17 incident at 2277 Towner Hill Road.

According to police, Boss' children found marijuana in the house and called police to the residence.

Boss has been sent a summons to appear before Magisterial District Judge Fred Wheaton on Oct. 8 for a preliminary hearing.

Sayre woman charged

A Sayre woman was recently charged with possession of drug paraphernalia by Athens Township police.

According to information filed with Magisterial District Judge Michael Shaw, Patricia Lee Firestine, 21, was arrested Aug. 19 after she was found to be in possession of a metal spoon, multiple needles, Suboxone and Fentanyl packets and other items at a Lewis Street residence.

Firestine was arraigned Aug. 19 and released from the Bradford County Jail on non-monetary bail. Firestine's preliminary hearing is scheduled for Aug. 27.

Woman charged with forgery

A Sayre woman was recently arrested by Athens Township police and charged with four counts of forgery.

According to papers filed with Magisterial District Judge Michael Shaw, Rebecca Anne Mitchell, 25, was also charged with theft by unlawful taking.

Police said Mitchell removed four checks from a relative and made them out to herself, forging the relative's signature, during June and July. Mitchell received a total of $285 from the checks, police said.

Mitchell was arraigned Aug. 19 and remanded to the Bradford County Jail in lieu of $15,000 bail. Mitchell's preliminary hearing is scheduled for Aug. 27.

Athens man accused of fleeing police

An Athens man was recently arrested by state police on a charge of fleeing or attempting to elude a police officer.

According to information filed with Magisterial District Judge Michael Shaw, Ethan Ardell Culver, 24, was also charged with driving with a suspended license.

Police said Culver, operating a Pontiac sedan, failed to stop for an officer attempting to pull his vehicle over Aug. 22 in the area of Route 220's Athens exit ramp. The vehicle had driven onto the rumble strips between Route 220's north and south lanes in the area of the state Department of Transportation shed in Athens Township, prompting an officer to follow Culver, police said. Culver's vehicle then reached a maximum speed of 70 miles per hour in a 55-mph zone, police said.

Culver turned right onto North Elmira Street and continued to Wheelock Avenue, pulling into a driveway, police said. Culver was then ordered to exit the vehicle and taken into custody. Culver told police his license was suspended, police said.

Culver was arraigned Aug. 22 by Magisterial District Judge Timothy Clark and released from the Bradford County Jail on non-monetary bail. Culver's preliminary hearing is scheduled for Aug. 27.

Man charged with theft

A Barton, N.Y. man was recently charged with theft by unlawful taking by Athens Township police.

According to papers filed with Magisterial District Judge Michael Shaw, Arthur G. Bidlack, 39, was also charged with receiving stolen property, theft from a motor vehicle and criminal trespass.

Police said Bidlack assisted in the removal of fuel cards from several vehicles at the Chesapeake complex in the township, then used one of the cards at a local gas station.

Bidlack's preliminary hearing is scheduled for Oct. 1.

Towanda man charged

A Towanda man was recently charged with defiant trespassing by Athens Township police.

According to papers filed with Magisterial District Judge Michael Shaw, Dana Edward Martin, 35, was also charged with disorderly conduct.

Police said Martin repeatedly used profane language July 9 at the Walmart store on Elmira Street and refused to leave when asked to by a store manager.

Martin's preliminary hearing is scheduled for Oct. 1.

DUI Charges

The following people have recently charged with driving while under the influence in Bradford County:

Luis Eduardo Nugra, 24, of Montrose, by state police, on Aug 16. on State Route 367 in Tuscarora Township.

Nugra has also been charged with careless driving, failing to stay in a single lane and driving at an unsafe speed.

A blood test revealed that on the day of his arrest Nugra had a blood alcohol content of .298 percent.

Nugra was arraigned on Aug. 17 by Magisterial District Judge Fred Wheaton and remanded to the Bradford County Correctional Facility in lieu of $40,000 bail.

Nugra has a preliminary hearing scheduled for Aug. 27 before Judge Wheaton.

Chester Michael Lawrence, 61, of Mehoopany, by state police, on Aug. 3, on State Route 6 in Wyalusing Township.

Lawrence has also been charged with failing to stay in a single lane, following too closely, driving at an unsafe speed and careless driving.

A blood test revealed that on the day of his arrest Lawrence had a blood alcohol content of .206 percent.

Nugra has been sent a summons to appear before Magisterial District Judge Fred Wheaton on Sept. 24 for a preliminary hearing.

Lexus Martinez Parsons, 21, of Sugar Run, by state police, on July 11, on State Route 187 in Terry Township.

Police said Parsons was involved in a two car accident and was found to be under the influence of alcohol.

Richard Alan Green, 49, of Sayre, by Sayre Borough police, on June 16, on West Lockhart Street in Sayre. Green has also been charged with failure to keep right. A blood alcohol test revealed that Green's blood alcohol content was .22 percent on the day of his arrest. Green has been sent a summons to appear Oct. 1 before Magisterial District Judge Michael Shaw for a preliminary hearing.

Simple trespass

MOUNT CARMEL - David Lackie, 30, of 146 W. Ogden St., Girardville, was cited by borough police for simple trespass and public drunkenness following a July 21 incident on North Walnut Street.

Police received a call from a woman who said an unknown male entered her home and she and her friends chased him out. Police later observed Lackie, who matched the description given by the caller, a couple of blocks away from the woman's residence. Officer Jason Drumheller, the officer who cited Lackie, also detected a strong odor of alcohol on Lackie's breath.

The citations were filed through Magisterial District Judge Hugh Jones, of Mount Carmel.

Disorderly conduct

MOUNT CARMEL - Mount Carmel Borough Police officer Jason Drumheller cited Jonathan Roland Starr, 19, of 429 Main St., Orangeville, for disorderly conduct after Starr was found climbing a street light pole in the 100 block of South Oak Street at 12:24 a.m. July 14.

The citation was filed through Magisterial District Judge Hugh Jones, of Mount Carmel.

Trespassing

MOUNT CARMEL - Jill L. Nye, 55, of 47 S. Orange St., was charged with disorderly conduct and trespassing by Mount Carmel Borough Police after an incident at 12:45 p.m. July 25.

Police said Nye was in the 100 block of South Oak Street yelling obscenities. Nye allegedly entered the Puffs Tobacco Store, from which she is banned because of a prior incident, and continued to use obscene language.

At a court proceeding Aug. 20, Nye pleaded guilty to a summary citation of disorderly conduct and was ordered to pay fines and costs totaling $205.50.

Disorderly conduct

MOUNT CARMEL - Borough Police Officer Jason Drumheller cited Robert Powers, 27, of 228 E. Seventh St., Mount Carmel, for disorderly conduct after an incident at 1:27 a.m. July 23 in the 200 block of East Sixth Street.

According to witnesses, Powers allegedly engaged in a fight with another male and threatened the bystanders at the scene of the incident.

The citation was filed with Magisterial District Judge Hugh Jones, of Mount Carmel.

Disorderly conduct

MOUNT CARMEL - Mashanna R. Kinney, 31, of 221 E. Avenue, was cited by borough police Cpl. David Donkochik, for disorderly conduct after police received a complaint about her dog barking at 10:15 p.m. Sunday.

Checks stolen

COAL TOWNSHIP - Gail Anthony, 52, of Kulpmont, is charged by Patrolman Jason Adams with theft, receiving stolen property and forgery.

She is accused of stealing two paychecks and forging the victim's signature before depositing the funds totaling $106.42 into her own bank account between 5:45 p.m. July 9 and 2:47 a.m. July 10.

Cars were broken into while parked at fitness clubs in Chesterfield, and the Chesterfield County/Colonial Heights Crime Solvers program needs your help to solve the cases.

Between 4:45 p.m. and 6:30 p.m. on Wednesday, July 10, several cars were broken into at the Midlothian Athletic Club, 10800 Center View Drive, and the Woodlake Aquatic Fitness Club, 14710 Village Square Place. In each case, purses were left in the vehicles in plain sight. Stolen debit cards, credit cards and checks were used, and the total monetary loss was substantial.

Security footage from the Gas Mart at 11201 Patrick Henry Highway in Amelia County revealed a black female suspect, 20-29 years of age. She wore a pink hooded sweatshirt and blue shorts, and she was seen in a black, Nissan sedan. A picture of the suspect and her car can be seen on the Crime of the Week page of crimesolvers.net.

The following information was provided by the Hopewell Police Department.

- Assault-Aggravated: At 8:35 p.m., Aug. 17, police responded to the 2800 blk of Gordon St in reference to shots fired. Known offender fired shotgun into residence, hitting victim and was later arrested.

- Assault-Aggravated/Domestic: At 9:40 p.m., Aug. 16, police responded to the 300 blk of S 13th Ave for a reported disturbance. During mutual argument, known offender stabbed victim in chest and was arrested.

- Burglary/Breaking And Entering/Residential: At 5 p.m., Aug. 12, police responded to the 400 blk of S 15th Ave for a reported larceny. Known offenders entered residence via unlocked rear door and stole several guns. Most of the guns recovered and offenders arrested.

- Burglary/Breaking And Entering/Residential: At 1 p.m., Aug. 13, police responded to the 2900 blk of Poplar St for a reported burglary. Unknown offender entered residence via unlocked door & stole mounted deer heads, clothing & A/C unit.

Waverly man charged

A Waverly man was recently arrested by Sayre borough police in relation to several instances of forgery that occurred in 2012.

According to information filed with Magisterial District Judge Michael Shaw, Matthew P. Gay, was charged with three counts of access device fraud after he deposited three stolen and forged checks into a checking account in Sept. 2012.

Police said Gay was also charged with forgery, receiving stolen property and theft by unlawful taking after he signed another person's name on two savings withdrawal slips and removed $100 cash from a bank account in Oct. 2012.

According to police, Gay also received charges of forgery and receiving stolen property after he forged a check for $700 and had it cashed for him in Oct. 2012.

Gay was arraigned and remanded to the Bradford County Jail in lieu of $10,000 bail. Gay's preliminary hearing is scheduled for Sept. 3.

Man charged with indecent assault

An inmate at the Bradford County Correctional Facility was recently charged with aggravated indecent assault on a person with a mental disability by Athens Borough police.

According to papers filed with Magisterial District Judge Michael Shaw, Tyler R. Finogle, 19, was also charged with indecent assault on a person with a mental disability.

Police said Finogle had inappropriate sexual contact with a minor female victim in July at a borough residence. The victim has a mental disability, police said.

Finogle was arraigned and remanded to the county jail in lieu of $10,000 bail. Finogle's preliminary hearing is scheduled for Sept. 3.

Vehicle vandalized

State police at Towanda are investigating the vandalism of a vehicle in Athens Township.

According to state police information, an unknown actor or actors poured sugar into the gas tank of a vehicle parked on McCloe Lane sometime on Aug. 16 or 17. The actor then fled the scene, police said.

Tools stolen

State police recently arrested a Waverly man on charges of theft by unlawful taking and receiving stolen property.

According to information from state police at Towanda, Matthew Temple, 31, removed hydraulic tools from the Weir Seaboard facility in Ulster Township sometime between June 18 and July 11. The tools were worth about $38,000, police said.

Temple was arraigned before Magisterial District Judge Timothy Clark and remanded to the Bradford County Jail in lieu of $2,500 bail.

Police investigate crash

State police at Towanda recently investigated a one-car motor vehicle accident in Ulster Township.

According to state police information, a 2004 Dodge Ram operated by Wade L. Sparbanie, 47, of Towanda, was traveling northbound on Route 220 at about 7 p.m. Aug. 16 when the vehicle struck a guide rail about two miles from Milan Road. The vehicle flipped about three times before coming to final rest, police said.

Sparbanie, who wore a seatbelt, had minor injuries but was not transported to a local hospital, police said. Police cited Sparbanie for failure to stay in lane.

The Ulster-Sheshequin Fire Association and the Ulster division of Tri-Township Ambulance assisted at the scene, police said.

Disorderly conduct charge

A Sayre man was recently arrested by borough police on a charge of disorderly conduct.

According to information filed with Magisterial District Judge Michael Shaw, John Hyjek, 33, was arrested after repeatedly yelling obscene language on North Keystone Avenue at about 1:30 a.m. Aug. 23.

Hyjek was arraigned Aug. 23 and remanded to the Bradford County Jail in lieu of $15,000 bail. Hyjek's preliminary hearing is scheduled for Aug. 27.

Michael Harrington of Warren Center, Pennsylvania was sentenced to two one year concurrent terms in Tioga County Jail and a three year conditional discharge upon conviction for Aggravated Driving While Intoxicated and Aggravated Unlicensed Operation of a Motion Vehicle in the First Degree.

Anthony Lattimer of Waverly, N.Y. was re-sentenced to nine months in Tioga County Jail and discharged from probation for violations of terms of probation upon conviction for Criminal Sale of a Controlled Substance in the Third Degree.

William Fenton, 36, Sayre, PA, entered a plea of guilty before Magisterial District Judge Michael Shaw to the offense of Harassment and was ordered to pay a fine of $300.00, and court costs. Officer Jeremy Horton of the Sayre Borough Police Department arrested Fenton for the offense in July 2012.

Thomas Bashore, 46, Sayre, PA, entered a plea of guilty before Magisterial District Judge Michael Shaw to the offenses of Loitering and Prowling at Night, Disorderly Conduct, and Public Drunkenness; as sentence thereon he was ordered to serve 10 days in the Bradford County Correctional Facility and pay court costs. Officer Bruce Huffman of the Sayre Borough Police Department arrested Bashore for the offenses in December 2012.

Isaac L. Strope, 60, Wysox, PA, entered a plea of guilty before Magisterial District Judge Fred Wheaton to the offense of Harassment and was sentenced to imprisonment in the Bradford County Correctional Facility for a term equal to the number of days already served at time of sentencing and he was ordered to pay court costs. Trooper Joshua Fisher of the Pennsylvania State Police arrested Strope for the offense in July 2013 following investigation of an incident that occurred in Wysox Township.

Timothy M. Manahan, 42, Laceyville, PA entered a plea of guilty before Magisterial District Judge Fred Wheaton to the offense of False Report to Law Enforcement Authorities and was sentenced to pay a fine and court costs. Trooper Miranda Musick of the Pennsylvania State Police arrested Manahan for the offense in July 2013 following investigation of an incident that occurred in Wysox Township.

Paul B. Vanderpool, 25, Towanda, PA entered a plea of guilty before Magisterial District Judge Fred Wheaton to the offense of Theft by Unlawful Taking and, as sentence thereon, was ordered to pay a fine and restitution in the amount of $116.80. Trooper Mark Sadowski of the Pennsylvania State Police arrested Vanderpool for the offense in May 2013 following investigation of an incident that occurred in Wysox Township.

Douglas W. Theft at Ulster Dandy Mini Mart

State police are continuing to investigate the report of theft at Dandy Mini Mart in Ulster. According to police, a white male believed to be about 40 years old stole various items from the store on Aug. 17 at 8:11 p.m..

Two car crash closes Route 6

Jonathan W. Brown, 23, of Towanda has been charged with driving at an unsafe speed relating to an accident that occurred on State Route 6 in North Towanda Township at 4:50 p.m. on Aug. 21.

According to police, Brown failed to see a vehicle stopped in the eastbound lane attempting to turn into The Edge Fitness and rear ended the vehicle.

Neither driver was injured during the accident and both vehicles were towed from the scene.

The road was closed for approximately 40 minutes as fire department personnel worked to clear the vehicles from the roadway.

Criminal mischief

URBAN - James Brosius, 74, of Dornsife, reported to state police at Stonington that someone damaged and dislodged his mailbox at 559 Hooflander Road in Washington Township, causing it to strike his residence. The incident occurred overnight Sunday.

A similar incident occurred more than six miles east at 306 Ernest Road, where a mail box owned by Brock Stine, 25, of Dornsife, was also damaged about 4 a.m. Sunday.

Damage to the mailboxes is estimated at $150 each. Another $150 in estimated damage was caused to Brosius' home, police said.

Fight at the races

RAKER - Candi Snyder, 29, of Shamokin, and Kathleen Cristan, 32, of Coal Township, will each be cited for harassment for fighting each other about 7:45 p.m. Saturday at Big Al's Race Track along Route 3004 in Little Mahanoy Township, state police at Stonington said.

House egged

TREVORTON - Debra A. Lesher, 41, of Mahanoy Street, reported to state police at Stonington that someone tossed two eggs onto her porch about 12:20 a.m. Aug. 19.

Vehicle damaged

TREVORTON - Michael Reward, 39, of Trevorton, reported to state police at Stonington that someone damaged his vehicle with a BB gun about 8 p.m. Thursday while it was parked in the 900 block of Railroad Street.

Underage drinking

KULPMONT - Brandon Taylor Chapman, 18, of 114 S. Walnut St., Mount Carmel, and a 16-year-old Coal Township male were each cited for underage drinking.

State police at Stonington said the two were passengers inside a vehicle that was stopped by police at 1:27 a.m. Saturday along Route 61, just east of the Coal Township line.

Police Briefs

Burglary occurs in Monroe Twp.

State police are trying to determine who forced their way into a residence recently in Monroe Township, police said.

Once inside, the burglar or burglars stole a hunting crossbow, police said.

The residence is owned by a 44-year-old Monroeton man, state police said.

The burglary occurred sometime between 12:30 p.m. Wednesday and 6:50 a.m. Thursday, police said.

Towanda woman charged with arrest prior to requisition

On Thursday evening, twenty-seven-year-old NovaJo Wright of Towanda was charged with arrest prior to requisition, police said.

Wright was arrested on the charge at a location on Bridge Street Hill Road in Towanda Township, police said.

Wright was then arraigned by Troy Magisterial District Judge Jonathan Wilcox and sent to the Bradford County jail in lieu of $65,000 bail, police said.

Wright has an active full extradition warrant from the Waverly Police Department for possession of a controlled substance, police said.

Wright is currently awaiting extradition to Waverly, N.Y., state police at Towanda said.

Burglary occurs in Cherry Twp.

A burglary has occurred at a garage on state Route 487 in Cherry Township, Sullivan county, police said.

The garage is owned by 53-year-old Jon Courtney of Quakertown, Pa., police said.

One or more individuals forcibly entered the garage and stole a Craftsman brand reciprocating saw, a SKIL brand circular saw, various hand tools, and approximately $10 worth of change, police said.

The burglary occurred sometime between May 28, 2012 and Aug. 24, 2013, police said.

Vandalism occurs in N. Towanda Twp.

Someone recently damaged a double-pane window on the back of the building at 20485 state Route 220 in North Towanda Township, police said.

The vandalism occurred sometime between 11 p.m. Tuesday and 7 a.m. Wednesday, state police said.

Man charged in Tuscarora Twp. theft

Phillip Mark Warfle Jr., 24, who is currently incarcerated in the Wyoming County Jail has been charged with entering an unoccupied structure, theft by unlawful taking or disposition and receiving stolen property relating to an incident that occurred between April 17 and April 18 at a private residence in Tuscarora Township.

According to police, Warfle entered a house in the middle of the night and stole various items including a credit card and $70 in cash.

Warfle was arraigned by Magisterial District Judge Fred Wheaton and remanded to the Bradford County Correctional Facility in lieu of $10,000 bail and is scheduled to appear before Judge Wheaton again on Aug. 27 for a preliminary hearing.

Man charged with dealing marijuana

Nicholas Christopher Mercado-Cummer, 23, of Traverse City, Michigan has been charged with possession with the intent to deliver a controlled substance, criminal use of a communications facility and possession of a controlled substance relating to a Jan. 23 incident at a private residence in Wysox Township.

According to police, Mercado-Cummer sold 11.4 grams of marijuana to a confidential informant.

Mercado-Cummer has been sent a summons to appear before Magisterial District Judge Fred Wheaton on Sept. 24 for a preliminary hearing.

Waverly police make arrests

Waverly village police recently made the following arrests, according to information from the Waverly Police Department:

Virgil J. Collins, 28, of Kansas, Okla., on Aug. 16, on a warrant out of the Village of Waverly for issuing a bad check.

Aaron D. Smith, 29, of Sayre, on Aug. 18, for driving while intoxicated, operating a motorcycle without a helmet and operating with an out of class license.

Eric J. Waters, 21, of Sayre, on Aug. 18, on a warrant for aggravated harassment out of the Schuyler County, N.Y. Sheriff's Office. Waters was turned over to the sheriff's department, police said.

Michael E. Comstock, 22, of Sayre, on Aug. 22, for criminal mischief, after breaking the glass of a storm door. Comstock was also taken into custody on a warrant out of the City of Elmira for petit larceny, police said. Comstock was turned over to the Elmira Police Department.

Man cited following Ulster incident

State police at Towanda recently cited an Ulster man for failing to have his dogs confined to his property.

According to state police information, Sean P. Dollard, 49, was cited after his two dogs were running loose on Cash Creek Road Aug. 20. A woman was operating an all-terrain vehicle on her property when the dogs caused her to roll the vehicle, police said.

Vacation home burglarized

State police are investigating the theft of items from a vacation home in South Creek Township.

According to information from state police at Towanda, an unknown actor or actors broke into the Roaring Run Road residence sometime between July 12 and Aug. 21 and removed several guns, tools and electrical items.

Garbage dumped

State police at Towanda seek an unknown actor accused of scattering rubbish in Sheshequin Township.

According to state police information, the actor dumped household garbage on a yard along State Route 1043 sometime between July 13 and July 30. Anyone with information is asked to contact state police at (570) 265-2186.

Two arrested following domestic incident

Athens Township police recently arrested two township residents on charges of simple assault and harassment.

According to information filed with Magisterial District Judge Michael Shaw, Greg Scott Brown, 28, and Tricia Marie Brown, 26, were charged following an argument at their Wilawana Road residence.

Both were arraigned Aug. 26 by Magisterial District Judge Jonathan Wilcox and released from the Bradford County Jail on their own recognizance. Their preliminary hearings are scheduled for Sept. 3.

Man charged with disorderly conduct

A Van Etten, N.Y. man was recently arrested by Sayre Borough police on a charge of disorderly conduct.

According to information filed with Magisterial District Judge Michael Shaw, Anthony Gerald Stutzenstein, 31, was also charged with resisting arrest and possession of drug paraphernalia.

Police said Stutzenstein tried to flee officers as police attempted to take him into custody on a warrant Aug. 22 in the area of the 300 and 400 blocks of North Elmer Avenue. Police found several items of drug paraphernalia on Stutzenstein's person, including hypodermic needles, alcohol prep pads, a rubber tie-off band and an aluminum mixing bowl, police said.

Stutzenstein's preliminary hearing is scheduled for Oct. 8.

DUI Charges

The following people have recently been charged with driving while under the influence in Bradford County:

Stephen Andrew Maines, 52, of LeRaysville, by state police, on Aug. 10, on State Route 706 at the intersection of State Route 409 in Wyalusing Township.

Maines has also been charged with failing to stay in a single lane, driving at an unsafe speed and careless driving.

On the night of his arrest Maines had a blood alcohol content of .199 percent.

Maines has been sent a summons to appear before Magisterial District Judge Fred Wheaton on Sept. 24 for a preliminary hearing.

Timothy Lee McDonald, 54, of West Lebanon, by state police, on Aug. 6, on State Route 6 near Dandy Mini Mart in Wysox.

McDonald has also been charged with operating a vehicle without proper registration and careless driving.

Police said McDonald refused to submit to a blood alcohol concentration test on the night of his arrest.

McDonald has been sent a summons to appear before Magisterial District Judge Fred Wheaton on Sept. 24 for a preliminary hearing.
